1. Acceptance of These Terms

These Terms & Conditions (the “Terms”) govern your use of the website at clan.security (the “Website”), which is operated by Clan Security (“Clan Security”, “we”, “us” or “our”). By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

If you use the Website on behalf of a company or other organisation, you confirm that you are authorised to accept these Terms on its behalf.

2. Changes to These Terms

We may change these Terms from time to time. When we do, we will post the updated Terms on this page and change the “Last updated” date at the top. Changes take effect when they are posted and apply only from then: they do not affect anything that happened, or any dispute that arose, before that date. If you continue to use the Website after a change, you accept the updated Terms.

3. Using the Website

You may use the Website to learn about Clan Security and Threat Sphere, and to contact us. You agree not to:

• use the Website in any way that breaks the law or infringes anyone’s rights;
• try to gain unauthorised access to the Website, the systems that host it, or any connected network;
• probe, scan or test the Website for vulnerabilities, or interfere with how it works or how it is secured, without our written permission;
• send spam, malicious code, or false or misleading information through the contact form or by email;
• use automated tools to access or copy the Website in a way that places an unreasonable load on it.

We may investigate suspected breaches of these Terms and, where appropriate, report them to the relevant authorities.

If you believe you have found a security vulnerability in the Website, please report it to respond_in_24hr@clan.security and do not test or investigate it further. Reporting a vulnerability does not give you permission to test the Website or to do anything else this section prohibits.

4. Information You Send Us

When you submit the contact form or email us, you confirm that the information you provide is accurate and that you are entitled to share it. Our Privacy Policy explains how we handle your personal information.

Sending us an enquiry does not create an agreement for us to supply any product or service, or a customer relationship, between you and Clan Security.

5. Intellectual Property

The Website and its content, including its text, graphics, logos, design, layout and underlying code, are owned by Clan Security or its licensors and are protected by copyright and other intellectual property laws.

Apart from viewing the Website and keeping copies of pages for your own reference or to assess Clan Security for your organisation, you need our written permission to reuse its content (for example, by publishing it elsewhere, adapting it or using it commercially), unless the law permits that use.

6. Trademarks

“Clan Security”, “Threat Sphere”, the Clan Security logo, and our other product names and logos are trademarks of Clan Security. You may not use our trademarks to identify or promote your own products or services, whether in a domain name or anywhere else, or in any way that could lead people to believe we are connected with you or endorse you. Any other names or logos on the Website belong to their respective owners.

7. Links to and from the Website

You are welcome to link to our homepage, provided the link is fair and does not imply a relationship with us that does not exist. Please ask us in writing before displaying our pages inside another website or hosting a copy of them.

Some pages may point to websites run by others. We have no say over what those websites publish or how they operate, so we cannot take responsibility for them, and any use you make of them is at your own risk.

We take reasonable steps to protect the messages you send us through the Website or by email, but no transmission over the internet is completely secure. A short, general description of your environment is welcome, but please do not send passwords, access keys, network details or other confidential information about your systems through the contact form or by email.

Nothing on the Website is an offer or a commitment to supply any product or service. Any use of Threat Sphere will be governed by a separate agreement between your organisation and Clan Security.

The Website does not provide security advice for your systems. The contact form and our email address are for business enquiries only and are not an incident-response or emergency service. We aim to reply within one business day but cannot guarantee a response time. If you are dealing with an active security incident, contact your own security provider or the relevant authorities.

10. Limitation of Liability

To the fullest extent permitted by law, Clan Security and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of, or inability to use, the Website or its content, even if we have been told that such loss is possible.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, such as liability for fraud, or for death or personal injury caused by negligence.

11. Indemnity

If you use the Website on behalf of an organisation, your organisation agrees to indemnify Clan Security and its officers, employees and agents against any third-party claim, and any resulting loss, damage or reasonable cost, that arises from your breach of these Terms or from material you send us through the Website that infringes someone else’s rights. This section does not apply if you use the Website as a consumer.

12. General

These Terms are the entire agreement between you and Clan Security about your use of the Website, unless we have agreed otherwise with you in writing. Our Privacy Policy explains how we handle personal information; it is a separate notice and does not form part of these Terms. Nothing in these Terms affects your statutory rights as a consumer. If any part of these Terms is found to be unenforceable, the rest remains in effect. If we do not enforce a right under these Terms, we have not waived it. We may transfer our rights and obligations under these Terms, for example as part of a merger or a sale of our business. You are responsible for complying with the laws that apply to your use of the Website.
